Employee Termination in Pakistan: Legal Requirements and Best Practices

Wrongful termination claims are among the most common employment disputes in Pakistan. Employers who fail to follow the correct procedures face significant financial exposure. We outline the legal requirements and how to protect your business.

Pakistan's labour laws provide significant protections to permanent employees against arbitrary dismissal. Employers who fail to observe proper procedures expose themselves to reinstatement orders, back-pay awards, and reputational damage.

Categories of Employees

The Industrial and Commercial Employment (Standing Orders) Ordinance 1968 applies to industrial and commercial establishments. It classifies workers as permanent, probationary, temporary, and casual — each with different termination rules.

Termination of Permanent Employees

Permanent employees cannot be dismissed without showing cause and following a prescribed procedure: (1) issuance of a charge sheet, (2) opportunity to respond, (3) domestic enquiry if contested, (4) reasoned order. Dismissal without following this process is void.

Retrenchment

Retrenchment (redundancy) is permissible but requires: one month's notice (or pay in lieu), retrenchment compensation at the rate of one month's wages per year of service, and notification to the appropriate labour authority.

Probationary Employees

Probationary employees (typically up to 3 months, extendable to 6 months) have fewer protections but cannot be dismissed on grounds that would constitute discrimination or victimisation.

Best Practices for Employers

Maintain written employment contracts, issue formal HR policies, document performance issues thoroughly before initiating any dismissal process, and follow the statutory procedure precisely. The cost of getting this wrong — reinstatement plus back pay — typically far exceeds the cost of proper process.
